**NFT Boss Battles Legal Documents** Terms of Service ================ CipSoft GmbH, Prüfeninger Straße 20, 93049 Regensburg, Germany ("CipSoft") operates the blockchain game NFT Boss Battles ("Game"). This service agreement ("Agreement") defines the terms and conditions on which CipSoft offers you access to the Game. By accessing the Game you accept these terms and conditions and state that you are of full legal age in your country. Due to the used distributed ledger technology, all your transactions in the Game will be visible to the public. See the [Privacy Policy](#privacypolicy) for more information. § 1 Subject of the Contract --------------------------- (1) CipSoft grants you access to the Game. It is your responsibilty to check the system requirements and to ensure that your connection to the internet is working. (2) CipSoft grants you the non-exclusive, non-transferable, limited right to use the Game for your personal use for gameplay on any device that you own or control. You acknowledge that no title or ownership in the Game is being transferred or assigned. This Agreement does not constitute a sale of any rights in the Game. All rights not specifically granted under this Agreement are reserved by CipSoft. (3) CipSoft reserves the right to develop the Game further, even if this incurs changes to the rules of the Game. § 2 Fees -------- (1) For every transaction in the Game, you have to pay a fee to a miner of the Binance Smart Chain network. The amount can be configured by yourself within the client and affects the time until the transaction is inserted into the Binance Smart Chain network. (2) For some of the transactions in the Game, especially trading with other players, you have to pay a fee to CipSoft (besides the fee that you pay to your trading partner). The amount will be shown before you submit the transaction. (3) All fees will be deducted from the Binance Smart Chain account you specify on the website. § 3 Duties of the Player ------------------------ (1) It is your duty to ensure the safety of your private key and password. You acknowledge that no recovery of lost private keys or passwords is possible. (2) You are responsible to ensure that all your transactions in the Game are legal in your country and your trading profits are taxed properly. § 4 Termination --------------- (1) You may terminate this Agreement, without cause and for no reason, at any time by not accessing the Game any longer. Due to the used distributed ledger technology, however, your account and your transactions in the Game cannot be deleted and will continue to exist. (2) CipSoft reserves the right to permanently shut down the Game thus terminating this Agreement at any time. § 5 Limitation of Warranty and Liability ---------------------------------------- (1) The Game is still in a testing phase. Therefore CipSoft does not guarantee continuous or error-free operation of the Game. CipSoft provides the Game "as is" and disclaims all warranties or conditions of any kind, expressed, implied or statutory, including, without limitation, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose. CipSoft reserves the right to temporarily shut down the Game at any time for maintenance reasons. (2) CipSoft cannot be held liable for loss of profit or any other special, incidental or consequential damages arising out of or in connection to the Game, unless said damages were caused by intentional or gross negligence on their part. (3) You play at your own risk and acknowledge that there is the possibility of extreme volatility of the currency exchange rate, the possibility of loss of value or currency by errors in the Binance Smart Chain network and the possibility of loss of value by errors or rule changes in the Game. § 6 Final Provisions -------------------- (1) CipSoft reserves the right to modify the terms and conditions of this Agreement at any time. The modification will be deemed accepted if you continue to access the Game. (2) In the event that one or more provisions of this Agreement should be or become invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provisions shall be deemed to be replaced with such legally permissible provisions which come as close as possible to the purpose of the invalid provisions. (3) This Agreement shall be governed by the laws of the Federal Republic of Germany, excluding any conflict of laws rules. This Privacy Policy explains in detail what personal data is collected and for which purposes it will be processed and used. The term "personal data" refers to information that can be used to identify, contact, or locate a single person or that can be used with other information to uniquely identify a single person. CipSoft is committed to safeguarding the information of the persons who play the Game and to ensuring that personal data is used fairly and with your full understanding of how it will be used. Please acknowledge, however, that due to the used distributed ledger technology, all your transactions in the Game will be visible to the public. Collected Data and Their Purpose -------------------------------- When you access the website of the Game, your IP address will be collected, processed and used in order to deliver the content. The website only uses cookies that reflect your state in the Game, but cannot be used to identify any person. When you contact CipSoft's customer support team, CipSoft will collect, process and use personal data in order to comply with such requests in as efficient and satisfactory a manner as possible. Data that is collected for such purposes includes, but is not limited to, the email address, the date of the contact and its content. Also, CipSoft processes and uses this data to compile anonymous statistical surveys for the optimization of their customer support. Disclosure to Third Parties --------------------------- All your transactions in the Game will be written in the blockchain and thus be visible to the public. Your country will be encoded in your transactions, so that CipSoft can fulfil their tax duties. Once written in the blockchain, transactions cannot be changed or deleted any more. CipSoft will pass on personal data, to the extent that is necessary, to law enforcement and supervisory authorities for the purpose of preventing dangers to the national or public security as well as for the prosecution of criminal offences. CipSoft will pass on personal data to its partner companies to provide services in the framework of your service agreement with CipSoft. Such partner companies may possibly be based in countries outside of the European Union, but they are bound to protect personal data to the same extent as CipSoft. CipSoft will not, aside from the aforementioned cases, pass on personal data to third parties, and only employees of CipSoft have access to personal data in order to fulfil the tasks specified above.
